When is remediation required?

The Victorian Environment Protection Act 2017 requires owners of contaminated sites to minimise the risks of harm to human health or the environment from contaminated land or groundwater through remediation and/or management.

Contamination may need to be reported to the Environment Protection Authority (EPA) together with information related to the proposed contamination management response (Duty to Notify of Contamination (s40).

The Act sets out specific requirements to meet obligations under the General Environmental Duty (GED), the Duty to Manage (DtM) contaminated land (s39) and the Duty to Notify of Contamination (s40).
